We know that many people contacting us want (and need) short-and-simple answers to questions about how the law effects their own particular situation and help to relieve fear about what might happen (or has happened) in their own situation, as well as whether there is really any need to hire an attorney to help resolve those issues.

 

Unfortunately, because of our professional ethical requirements (and because we need to make sure that we have enough information to provide well-reasoned and complete advice), we cannot give legal advice about any specific situation to anyone who has not retained us as their legal counsel.

 

We do this because, although the law sometimes seems "simple," it is not. Family law is far from "black-and-white" and what might seem like a simple question often contains an amazing patchwork of interlocking questions and issues. We also need to make sure that we don't have any conflict of interest with various people who ask our advice. We often receive inquiries from people on opposite sides of the same issue and we need to make sure that we aren't giving advice to both sides; therefore, we try to make sure that we are certain of the identity of the people to whom we give advice.

Also, since we are not now your "retained counsel," any information you share with us -- and any advice that we give -- is not protected by any attorney-client privilege and we want to make sure that the advice we give is completely confidential. Accordingly, although we are responding back to you, this email is informational only, does not contain legal advice, and does not create an attorney-client relationship.

Finally, we do not provide "free consultations" Over the years, we've found that the most important advice we give to our clients is the advice we give in our first meeting. That first advice is often critical in how the situation is later handled and can make thousands of dollars of difference in litigation fees. Therefore, we charge $500.00 for initial consultations -- whether that consultation is in-person, over the telephone, or a detailed email response.

We do not charge flat fees, minimum fees, or maximum fees and the ultimate cost for any case we handle depends on the amount of time we have to work on it, including research time, conference time, and analysis at our then current hourly attorney’s fee ($350/hr). If we enter an appearance in ongoing litigation, the cost depends wholly on other factors, such as how much (or how little) agreement there is between the participants; whether the issues involve child custody or child support support issues; whether there is real estate involved; the extent of the property and debt that is in dispute; and the emotional level of everyone involved in the case (whether they are the actual participants or family members of the participants); and whether the case involved "high conflict."

 

If we do more than just a one time consultation, then we require a retainer (security deposit) that we keep in our firm trust account and against which we bill on a monthly basis any accumulated fees and expenses. Our retainer amount depends on the nature of the case, but we typically require at least a $3,500 retainer for simple matters and from $7,500.00 to $20,000 or more if the case will be ongoing (such as a divorce filing, appeal, or modification of previously filed orders). The retainer established does not determine the maximum fee be charged (or the minimum). The retainer is only an "upfront" security deposit so that we can be sure that we always have a fund against which to bill fees and expenses at billing dates. Moneys left in the retainer account at the end of  representation are refunded.
